The Sexual Harassment of women at workplace -Prevention, prohibition & redressal act 2013 is a legislative achievement that was much needed to save the female gender from the unspoken atrocities at the work front.
The famous Vishakha guidelines have been formally encased and hold the employer responsible and accountable for sexual harassment in the workplace.
Section 2(o) of the Posh Act states that all government/ private sector organizations/ establishments/institutions, NGOs, vocational, educational,industrial, health service providers,organized or the unorganized sectors, etc need to provide a safe haven for their women workforce. The act also provides for the Employers to form the Internal complaints committee and the Local complaints committee as part of the redressal mechanism. The Act also makes the Employer liable to certain penalties in the absence of such measures. The Employees need to be sensitized through workshops and seminars to understand the working of such a committee if in the scenario a sexual complaint is to be reported. Not only the employee needs to know how to file a complaint ? How to deal with the consequences? What are the penal options in case of the accusation being proved/ etc ? But the employer also should be well equipped to deal with such matter of fact situations wherein a complaint arises, questions like How to deal with the complaint ? How to form a committee? Where to report the case further? Measures to be dealt with Incase the accused is proven guilty? Etc.
